Attorney Jason Webster Files Lawsuit over Drowning Death of Teen

Jason Webster, founder of The Webster Law Firm, announced he recently filed a lawsuit in the District Court of Travis County Texas (Case No. D-1-GN-15-004671) on behalf of the mother of a 15-year-old girl who drowned in Lake Travis, due to alleged negligence.

According to court documents, Linda Pool (plaintiff) is suing Austin Ridge Bible Church and Andrew Lossing (defendants) for the death of her daughter, Sarah, who drowned at Lake Travis while attending the church’s “One Wakeboard Camp” on June 11, 2015. Court records state that the church and Lossing, the boat operator, were allegedly negligent and caused Sarah’s death.

“Court documents further state that Sarah, a triplet and freshman at Westlake High School, while attending the wakeboarding camp was hanging onto a platform on the back of the boat,” said Webster, who made the Texas Super Lawyers list in 2014. “She then went underwater and did not resurface.”

According to court documents, Linda Pool is claiming Lossing allegedly failed to supervise the girls aboard the boat and allowed Sarah to remove her life jacket. Additionally, Lossing allegedly failed to prevent her daughter from breathing too many exhaust fumes and allegedly did “nothing” when the girls complained about it.

Court documents further state that Lossing was allegedly driving the boat at an unsafe speed, allowing high amounts of exhaust to envelope the interior of the boat, especially in the rear where the children were riding, sitting, and playing, and allegedly the defendants did not supply enough activity-appropriate and age-appropriate life jackets for all of the children on the boat. Furthermore, court documents allege that Lossing was the only adult on the boat and the only adult provided by the church and the defendants’ acts and omissions directly and proximately caused Sarah’s suffering, injuries, and death.

The plaintiff in the case, according to court documents, is seeking more than $1 million in damages, including relief for medical expenses, emotional and physical pain, funeral expenses and court costs. “I just want to help bring this family some closure,” said Webster.

In addition to the aforementioned case, Webster is involved in a $2.4 billion settlement case against Takeda Pharmaceutical. The case, filed in the Second Court of Cook County, IL, No. 2011L010011, involves thousands of lawsuits from patients and their family members who claimed that the company’s diabetes drug Actos allegedly caused bladder cancer.
