Joe Stanley shares things to consider about premises liability, which according to NOLO, is a legal concept that typically comes into play in personal injury cases where the injury was caused by some type of unsafe or defective condition on someone’s property. “This includes construction site accidents,” said attorney Joe Stanley, who focuses on serious personal injury, “and construction picks up in spring when people tend to get out and enjoy the good weather.”
In order to educate people on premises liability, and what they are liable for, Stanley shares the following three tips:
No. 1: Misconception. "One common misconception is that people think just because they are hurt on someone’s property that the property owner is responsible,” said Joe. “When people are injured at any property they must report it. If they don’t, it can have serious consequences.”
No. 2: Prevention. “In order to prevent injury, home and business owners should conduct regular inspections of the house and/or business to check for unsafe conditions,” said Joe.
No. 3: Documentation. In case of an accident, home or business owners and injured parties should always document the incident, name(s) of witnesses, take pictures, etc. They should also notify their insurance company immediately.
“In today’s electronic age it is important to document any important occurrence or transaction,” said Joe. “Verbal discussion is not the best method to prove what did or did not happen.”
