Immigration Attorney Carlos E. Sandoval Urges ‘Dreamers’ to Renew DACA Status 

South Florida immigration attorney Carlos E. Sandoval is advising all immigrants who currently have DACA to apply to renew their status immediately, and offers assistance to anyone in the program to ensure they know their rights and how to complete the renewal process.

Deferred Action for Childhood Arrivals (DACA) is an Obama-era immigration policy that allows individuals who entered the country as minors, aka “Deamers,” and had either entered or remained in the country illegally, to receive a renewable two-year period of deferred action from deportation and to be eligible for a work permit. Recently, and for the second time, a federal judge has barred the Trump administration from ending the Obama-era DACA program.

U.S. District Judge Nicholas Garaufis in New York ruled that Attorney General Jeff Sessions had “erred in concluding that DACA is unconstitutional.” Based on its review of the record before it, the court concludes that Trump officials have not offered legally adequate reasons for ending the DACA program.

The judge also ordered that DACA recipients should be able to renew their protected status. However, a spokesperson for the Department of Justice indicated that the Trump administration would fight back legally against the injunction. The Trump administration appealed before the Supreme Court to remove the injunction put in place by the district courts, but the Supreme Court ruled against the administration, keeping in place the injunction, and allowing the case to move forward in the lower courts.

Immigration attorney Carlos E. Sandoval is urging all immigrants who currently have DACA to apply to renew their status now.

“This gives people who currently have DACA hope, and the possibility to continue to be protected by the program,” said Sandoval, founder of Carlos E. Anyone who was applying to renew their DACA, and it was denied by USCIS based on the Trump decision, can file again for DACA. The Department of Homeland Security must continue to accept renewal applications from the approximately 700,000 young people who are currently enrolled in the program.
