Attorney Carlos E. Sandoval (http://www.carlosesandoval.com), Southern Florida immigration attorney, says it is time for undocumented aliens to begin compiling proof of their time of residence in the United States, with immigration relief right around the corner.
President Barack Obama outlined the President's Immigration Accountability Executive Actions during a televised event on Thursday, November 20th. The plan will help secure the border and give relief to nearly 5 million undocumented immigrants.
Immigration attorney Carlos E. Sandoval suggests prospective applicants begin compiling proof of their time of residence in the United States, such as pay-stubs and/or income tax returns, as well as civil documents of any relatives they have in the United States, especially spouses and children. If they have had any arrests, they should obtain police reports and final court dispositions of the arrests to be able to determine whether the arrest(s) disqualifies them from applying.
"I immigrated to the United States from Colombia in 1996, so this means quite a lot to me, personally. I am here to help and am encouraging illegal immigrants in the area to call if you need help navigating these next steps or if you're not sure whether you may qualify for legal status. You can call our office at 954-306-6921,” said Attorney Sandoval.
Parents of U.S. citizens and lawful permanent residents (of any age) who have been continuously present since 1/1/10, and who pass background checks and pay taxes, will be eligible to apply for deferred action in the next 6 months. Also, those individuals with an approved employment-based immigrant petition who may be caught in the quota backlogs to file for adjustment of status will be advanced to permit them to obtain the benefits of a pending adjustment. This is expected to impact about 410,000 people.
During his term in office, President Obama has indicated that one of his priorities was to fix the outdated immigration system of the United States. While waiting for Congress to work on a comprehensive immigration reform, he has used his executive powers to focus federal efforts and resources on the deportation of aliens with criminal backgrounds, who pose a risk to the national security of the United States. He has also exercised prosecutorial discretion to stop the deportations of immigrants which the government considers a low priority, such as people that came to the United States when they were children, and don’t have criminal records.
