Attorney Bradley Hofland Examines Essential Elements of Filing for Divorce

Bradley Hofland, founder of Hofland & Tomsheck Attorneys and Counselors at Law, lists the top five tips when filing for divorce.

LAS VEGAS, NV

Filing for divorce is a stressful experience for all parties involved. Furthermore, the selection of an attorney to prepare a case for presentation to the court is the most important task in the divorce process.

“In selecting an attorney, you must feel 100% confident with your attorney in guiding you through the process,” said Bradley Hofland, managing partner of Hofland & Tomsheck Attorneys and Counselors at Law. “While you may want your attorney to make you feel good about your decisions, it is more important for your attorney to understand your goals and develop a plan with you to obtain your goals.”

For those filing for divorce, Hofland, who has litigated thousands of family law cases, shares the following five crucial tips:

No. 1: Meet with an attorney. “The first step is to meet with your attorney and make sure your attorney understands your immediate needs and your goals after the divorce is finalized,” said Hofland. “This includes a strategy to accomplish a one-year goal, a five-year goal and a ten-year goal.”

No. 2: Fill out a financial declaration form. This form should include a listing of all of one’s assets, debts and any monthly financial payments one makes to maintain those assets. “Provide copies of all bills, debts, bank statements and credit cards to your attorney,” said Hofland. “You should also provide copies of all 401k, PERS, FERS, life insurance policies, retirement and pension plans to your attorney.”

No. 3: Present a history of the marriage. “It is imperative that you provide your attorney with a chronology of the events that transpired during your marriage,” said Hofland. “Your attorney needs this information to explain why you are entitled to the relief you are seeking.”

No. 4: File a motion. When filing a complaint for divorce, it is also important to file a motion for temporary financial or custodial relief within 30 days after the complaint is filed. “The longer you wait, the less likely the court will be inclined to grant you temporary relief,” said Hofland. “Also make sure your complaint for divorce adequately identifies your assets, debts and describes what relief you want from the court.”

No. 5: Communicate. “It is essential when filing for divorce to frequently communicate with your attorney,” said Hofland. “Your attorney will have extensive knowledge of and experience in the divorce process, and his or her direction should be followed.”
