Attorney D. Sunny Delitala Discusses Immediate Measures to Take if Injured at Work

Southern California workers’ comp attorney D. Sunny Delitala, founder of the Law Offices of Delitala, lists the top five tips on what to do if injured at work.

“Work-related injuries are not confined to those that occur at one’s workplace or office building. They can also include slip and falls, motor vehicle accidents, chronic conditions caused by one’s work duties and/or work environment, injuries sustained while at a job site or on the way to a different work location, etc.,” said Delitala, whose mission, as an attorney, is to help as many people as possible not be taken advantage of by insurance companies.

To ensure injured workers obtain the workers’ comp benefits they’re entitled to, Delitala, who has a 5-star Avvo rating, shares the following five tips:

No. 1: Immediately report the injury to a manager, supervisor or superior. Once reported, it is imperative that one’s employer, manager, supervisor, or superior provide them with a DWC-1 form to report the injury in writing. Injured worker should keep a copy of the completed DWC-1 form. 

No. 2: Obtain copies of all documents. “If injured on the job, you should always demand and obtain copies of anything and everything that you fill out or complete related to you reporting a work-related injury,” stressed Delitala. “If necessary, injured workers should take photos of injuries and/or the location/scene of the injury.”

No. 3: Seek medical treatment. It is also crucial to not wait for the employer to provide medical treatment. “Do not listen to your employer if they say you cannot obtain medical treatment. If you need to see a doctor, do so immediately,” advised Delitala.

No. 4: Inform the treatment provider of your injury being related to work. Tell the doctor or treatment provider how the injury occurred or how you think it occurred and that you were working when the injury occurred. “Oftentimes, your initial report of the injury to a treatment provider can have an impact on your case and your rights,” added  Delitala. 

No. 5: Call an attorney to discuss your injury and your rights. “Remember that the workers’ compensation insurance company’s client is your employer, not you, so you’ll need someone on your side who can fight for the full and fair compensation the law says you are entitled to,” concluded Delitala.
